BRONX, NEW YORK (August 10, 2025) – At least two people were injured in a Pelham Parkway apartment fire at a six-story building on Bronx Park East and Thwaites Pl.

Liability for New York City Apartment Fires

Many people are injured in residential fires each year. According to data from the US Fire Administration, there were 344,000 fires across the United States in 2023 alone. These incidents resulted in 2890 deaths and 10,400 injuries. These incidents also caused over $11 billion in financial losses. There are numerous causes of residential fires.

  • Cooking accidents
  • Electrical fires
  • Lit candles
  • Space heaters

Property owners in New York have a legal obligation to maintain their premises in a reasonably safe condition. This includes abiding by all fire regulations and taking proactive steps to prevent fires. Even when fires are not preventable, their damage can be mitigated through the implementation of certain measures.

  • Certain buildings will need to have fire escapes.
  • Apartments will need to have functional smoke detectors.
  • Illuminated fire escapes can help move people to safety after a fire.

When a property owner has actual or constructive notice of a dangerous condition on their property, they must take action. If a property owner fails to take action to protect residents from a dangerous condition, this may be negligence. Any person injured in a residential fire may be able to seek some measure of accountability through a civil action.
