Liability for Manhattan Hit-and-Run Collisions

Hit-and-run accidents have become increasingly common across the United States and New York. According to the AAA Foundation for Traffic Safety, “In 2016, there were 1,980 fatal hit-and-run crashes resulting in 2,049 fatalities. This is the highest annual number of hit-and-run fatalities or crashes recorded since NHTSA began compiling statistics on fatal motor vehicle crashes in 1975.” Many different factors could contribute to a hit-and-run collision.

  • A large portion of hit-and-run collisions involve an intoxicated driver.
  • Hit-and-run collisions are more likely to take place at night and during periods of low visibility.
  • Drivers are more likely to hit pedestrians when they are speeding.

All drivers must use caution in order to avoid colliding with any vehicle or pedestrian. They must be particularly cautious around children or pedestrians who appear confused. This may necessitate that they use their horns to alert pedestrians of their presence. It is a crime for any driver to flee the scene of a collision that results in bodily injury. Drivers that flee injury collisions may face civil and criminal liability for their actions. Certain steps should be taken after any hit-and-run collision.

  • Surveillance footage that may have captured the collision should be sought.
  • Photos of the accident site should be taken.
  • Fragments of the fleeing vehicle should be examined.
  • An experienced personal injury attorney should be contacted.

Pedestrian accidents are often highly preventable. They tend to involve drivers that are disobeying traffic regulations. Many of the drivers involved in these collisions end up fleeing because they are scared of potentially going to jail. It is important for victims of pedestrian accidents to understand that they do have legal options. They’re able to seek some measure of accountability through a civil claim. In particular, the family of any person who died in a pedestrian collision may be able to file a wrongful death claim.
