Thousands of pedestrians are killed or seriously injured in car accidents every year. According to the GHSA, “Drivers struck and killed 3,304 people walking in the United States in the first half of 2024, down 2.6% from the year before but up a staggering 48% from 2014.” There are many different factors that could contribute to a pedestrian collision.
Drivers have a legal obligation to avoid colliding with pedestrians in the roadway. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. When drivers fail to avoid a pedestrian, they could be held at fault through a civil action. It is important that evidence be properly preserved after any accident.
Pedestrian accidents are often highly preventable. In fact, it has been estimated that 93% of all fatal collisions involve some amount of human error. It is important that accident victims understand that they do have legal rights. In particular, the family of any person killed in a Brentwood collision may be able to seek some measure of accountability through a civil action.
We at GLK Law extend our deepest condolences to the family of the pedestrian killed in this collision. There needs to be a thorough investigation into what went wrong. It is our hope that steps are taken to make this intersection safer.
