Speeding remains one of the main causes of car accidents in the United States. According to the National Security Council, “Speeding was a factor in 29% of all traffic fatalities in 2022, killing 12,151, or an average of over 33 people on a typical day. The total number of fatal motor-vehicle crashes attributable to speeding was 10,922.” There are a number of ways that speeding could contribute to a car accident.
Drivers must exercise due care to avoid collisions. Pursuant to New York Vehicle & Traffic Law § 1180, no person is allowed to operate a motor vehicle faster than what would be prudent or safe given the prevailing conditions of the roadway. If a driver fails to slow down in order to avoid a collision, this could form the basis of a negligence claim. It is important that certain steps are taken after any fatal collision.
Accidents are often one of the most difficult experiences that most people go through in their lives. Accident victims are often left with high medical bills. They also may sustain permanent and debilitating injuries that impair their ability to work. It is crucial that accident victims take certain steps in order to preserve their health and legal rights. They should seek the guidance of an experienced New York City pedestrian accident attorney.
