STATEN ISLAND, NEW YORK (July 22, 2024) – A 25-year-old man tragically died in an Elm Park, Staten Island car accident at the intersection of Morningstar Road and Dixon Avenue.
New York City police officials are saying that the accident took place at 7:24 p.m. on Tuesday night. A motorcyclist was involved in a collision with a Hyundai SUV traveling eastbound on Dixon Avenue.
Firefighters and paramedics were called to the scene of the collision in order to help the victim. Despite life-saving measures, he later died due to his injuries.
A full investigation remains ongoing at this time.
Motorcyclists have a naturally small profile and lack the protection of enclosed vehicles. According to the National Safety Council, “Although motorcycles make up only 3% of all registered vehicles and 0.7% of all vehicle miles traveled in the United States, motorcyclists accounted for 14.6% of all traffic fatalities and 3.5% of all injuries in 2022.” Drivers should take a number of measures in order to avoid hitting motorcycles.
All drivers have a legal obligation to exercise due care in order to avoid collisions. Many collisions involve drivers that go past stop signs. Pursuant to New York Vehicle Code 1172, the driver of any vehicle approaching a yield sign shall stop and only proceed when it is safe to do so. If a driver hits a vehicle after going past a yield sign without yielding, this may be considered prima facie evidence of their failure to yield. Victims of motorcycle accidents tend to suffer very serious and costly injuries.
The vast majority of motorcycle collisions are preventable and involve some amount of driver error. In many situations, drivers are not adequately scanning the road ahead of them. It is important for accident victims and their families to understand that they do have rights. The family of any person who died in a motorcycle collision may have legal recourse through a civil claim.
We at Gersowitz Libo & Korek, P.C. extend our deepest condolences to the family of the motorcyclist that died in this Elm Park collision. Any person who may have more information about what happened should reach out to the police. There needs to be a thorough investigation into what happened.
