Liability For Brooklyn Car Accidents

Far too many people are killed or seriously injured every year in car accidents involving scooters. According to New Atlas, “One 2020 study published in JAMA Surgery found the incidence of annual e-scooter injuries in the US climbed from 4,582 in 2014, before the emergence of ride-share scooter companies, to 14,651 in 2018, when they had become far more commonplace.” There are a number of factors that could contribute to an e-scooter accident.

  • Inclement weather
  • Poor road conditions
  • Distracted driving
  • Dangerous left turns

All drivers must exercise due care in order to avoid causing accidents. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a driver fails to slow down in order to avoid hitting scooter drivers, this could form the basis of a negligence claim. Victims of car accidents tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

Scooter accidents are often highly preventable. This is particularly true when drivers are already parked. Drivers should be aware of their surroundings and avoid opening doors into the path of scooter riders. It is important for scooter riders to understand that they do have rights. Any person injured in a scooter accident may have legal recourse through a civil claim.
