Liability for New York City Apartment Fires

Residential fires remain a leading cause of preventable injury and death across New York. According to the National Fire Protection Association, “In 2023, local fire departments responded to an estimated 1.39 million fires in the United States. These fires caused an estimated 3,670 civilian fire deaths and 13,350 reported civilian fire injuries. The property damage caused by these fires was estimated at $23 billion.” Many different factors could contribute to any apartment fire.

  • Cooking accidents are one of the leading causes of apartment fires.
  • Many fires are caused by defective lithium-ion batteries.
  • Fires can also be started from electrical malfunctions with a building’s wiring.

Apartment owners have a legal obligation to maintain their premises in a reasonably safe condition. They must perform routine maintenance and inspections on all appliances. When an apartment owner has actual or constructive notice of a dangerous condition on their property, they must take action. If an apartment fails to protect against known dangers, this could form the basis of a product liability claim. Victims of residential fires may suffer serious injuries.

  • Organ damage
  • Burn Injuries
  • Death

Apartment fires are often highly preventable. They tend to be the result of major safety lapses. It is important for accident victims to understand that they do have legal rights. They are able to seek some measure of justice through a personal injury claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering.
