QUEENS, NEW YORK (October 23, 2025) – A female construction worker has tragically died in a South Ozone Park, Queens car accident along the Nassau Expressway by Van Wyck Expressway.

New York City officials are saying that the collision took place around 7:30 a.m. on Friday. A woman was working as a flagger for a construction site when she was hit by a 2018 Infiniti Q50S traveling at a high rate of speed.

Paramedics were called to the scene of the collision to help the victim. Sadly, she was pronounced dead at the scene.

The driver of the Infiniti did not remain at the scene of the collision. A full investigation into the crash remains ongoing.

Liability for New York City Car Accidents

Car accidents remain a leading source of worker injury and death. According to the National Safety Council, “Injuries resulting from roadway incidents involving motorized land vehicles is the leading cause of work-related deaths. In 2023, 1,252 workers died and in 2021-2022, 68,560 DART cases including 54,830 DAFW cases were reported.” There are a number of common causes of pedestrian collisions.

  • Speeding
  • Distracted driving
  • Inclement weather
  • Poor road conditions

All drivers have a legal obligation to exercise due care to avoid colliding with pedestrians. Drivers must be particularly cautious if they encounter any person in the roadway. They must slow down in marked construction zones and obey signs of construction flaggers. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. It is important that certain steps are taken after any pedestrian collision.

  • Surveillance footage of the accident should be sought.
  • Medical records related to the crash should be preserved.
  • Eyewitnesses should be interviewed.
  • An independent investigation into the circumstances of the collision should be conducted.

Depending on the circumstances of any collision, there could be numerous sources of liability for any collision. For example, a construction company could bear some legal responsibility. Construction companies have a legal obligation to maintain worksites in a reasonably safe condition. If they fail to maintain a worksite in a safe condition and a worker is killed, they could be held at fault for any resulting damages.
