The number of people seriously injured or killed in bicycle accidents has continued to climb over the last several years. According to the National Safety Council, “The number of preventable deaths from bicycle transportation incidents increased 10% in 2022 and have increased 47% in the last 10 years (from 925 in 2013 to 1,360 in 2022).” Drivers should take a number of measures in order to avoid collisions.
Drivers must operate their vehicles in a safe manner in order to avoid collisions. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a driver fails to slow down to avoid hitting a bicyclist, this could form the basis of a negligence claim. It is important that certain steps are taken after any bicycle accidents.
It can be hard to know what to do after a bicycle collision. Victims often suffer very serious injuries, which can impact their ability to work or go to school. To make matters worse, drivers and their insurance providers will often do everything in their power to deny liability for a collision. A bicycle accident attorney can examine the unique facts of your case and let you know what your legal options are.
