Bystander Helped Save Motorcyclist Seriously Injured In New Rochelle Collision With Utility Truck
NEW ROCHELLE, NEW YORK (October 5, 2024) – A motorcyclist was seriously injured in a New Rochelle car accident involving a utility truck.
New Rochelle officials are saying that the incident took place around 2:10 p.m. on Wednesday. A motorcyclist was involved in a collision with a work utility van.
The collision left the motorcyclist with a severe leg injury. A passerby witnessed the crash and helped the motorcyclist before the police were able to apply a tourniquet.
The victim was taken to the hospital in order to receive treatment. A full investigation remains ongoing at this time.
Motorcyclists are uniquely vulnerable to the hazards posed by motor vehicles. According to the National Safety Council, “Although motorcycles make up only 3% of all registered vehicles and 0.7% of all vehicle miles traveled in the United States, motorcyclists accounted for 14.6% of all traffic fatalities and 3.5% of all injuries in 2022.” There are a number of factors that could contribute to a motorcycle collision.
Drivers have a legal obligation to exercise due care in order to avoid collisions. Many collisions involve drivers making dangerous left turns. According to New York Vehicle Code 1141, “The driver of a vehicle intending to turn to the left within an intersection or into an alley, private road, or driveway shall yield the right of way to any vehicle approaching from the opposite direction which is within the intersection or so close as to constitute an immediate hazard.” Victims of car accidents tend to suffer very serious injuries.
If a truck driver was working at the time of a collision, their employer could be held at fault. According to Judith M. v. Sisters of Charity Hosp., 93 N.Y.2d 932, 933 (1999) respondeat superior will apply “so long as the tortious conduct is generally foreseeable and a natural incident of the employment.” Any person injured in a truck accident may be able to seek some measure of justice through a civil claim.
