NYC Department of Health Investigates Source of Upper East Side Legionnaires’ Disease Outbreak That Injured 14
UPPER EAST SIDE, MANHATTAN (July 5, 2026) – An estimated 14 people are confirmed to have been diagnosed with Legionnaires’ disease on the Upper East Side.
New York City officials are saying that the outbreak first began on July 2. The individuals come from multiple different ZIP Codes, including 10075, 10028, and 10128.
Those all fall within the investigation zone. The NYC Department of Health is currently investigating the source of the outbreak.
Past outbreaks have been caused by legionella bacteria that spread from the midst of cooling towers. If a building owner has any cooling towers that test positive for legionella bacteria, they will be directed by the city to conduct full remediation.
Legionnaires’ disease can potentially be lethal if it is not treated early. Older New Yorkers or those with chronic lung conditions are particularly at risk.
Property owners in New York City have a legal obligation to maintain their premises in a reasonably safe condition. This must be done for all people whose presence at a property is reasonably foreseeable. This obligation to maintain a safe environment necessitates that property owners adequately monitor their water systems and take all measures necessary to prevent Legionnaires’ disease outbreaks. There are a number of different ways that property owners may have acted negligently and allowed legionella bacteria to grow in their water systems.
If a property owner has actual or constructive notice of a dangerous condition on their premises, they must take action. Failure to take action can form the basis of a negligence claim. Even if a property owner did not know about a dangerous condition on their premises, they could still be legally responsible if it is reasonable that they should have known about the dangerous condition. Among other things, property owners must perform periodic inspections of their water systems.
Legionnaires’ disease is a very severe kind of pneumonia. People contract the disease by breathing in legionella bacteria. A number of people become sick with Legionnaires’ disease each year. According to the Cleveland Clinic, “Around 10,000 people in the U.S. are diagnosed with it every year. Legionella also causes Pontiac fever, a less serious illness with flu-like symptoms. Legionnaires’ disease can be life-threatening.” Seven steps should be taken after any person thinks that they may have contracted the illness.
People who come in contact with legionella bacteria may not begin showing symptoms right away. In many cases, symptoms can start 2 to 14 days after exposure. Depending on the specific facts of any case, there could be several sources of liability for any instance of a Legionnaires’ disease outbreak.
