OSHA Investigation Fatal Accident After Construction Flagger Hit By MTA Train Near Yankee Stadium

BRONX, NEW YORK (September 5, 2026) – A construction flagger has tragically died in a train accident near the Yankee Stadium, according to the MTA.

New York City officials are saying that the accident occurred just before midnight on September 4. For undetermined reasons, the worker was hit by a passing train and critically injured in the process.

Firefighters and paramedics were called to the scene of the crash to help the victim. He was taken to a local area hospital to receive treatment. Unfortunately, he was later pronounced deceased at the hospital.

A full investigation by OSHA remains ongoing at this time.

Liability for New York City MTA Accidents

Federal law requires that workplaces maintain a reasonably safe environment for all of their employees. Pursuant to 29 U.S.C. § 654(a)(1), “each employer shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees.” There are a number of steps that employers should take to prevent train accidents.

• Workers should be provided with high visibility vests.
• Workers should not be allowed to work on tracks when there is an active train nearby.
• Employers should establish exclusive track-occupancy zones that prevent trains from entering without authorization.
• Employers should use lookouts and warning devices when needed.

When an employer fails to maintain the premises in a reasonably safe condition, they could be held strictly liable for any resulting accident under New York labor law 200. The statute is a qualification of an employer’s obligation to maintain their premises in a safe condition. Unfortunately, employers will often fight to deny responsibility if a worker is injured in their care. That’s why it’s so important that these incidents are properly investigated by an outside party.
