School buses are typically very safe for passengers. But they can be particularly dangerous for pedestrians and those in smaller vehicles. According to the National Safety Council, “School bus-related crashes killed 104 people nationwide in 2022, down 3.7% compared to the 108 deaths in 2021, according to National Safety Council (NSC) tabulations of data from the National Highway Traffic Safety Administration (NHTSA).” Bus drivers should take a number of measures in order to avoid collisions.
Bus companies are considered common carriers, and their drivers must do everything in their power to avoid collisions. A large number of bus accidents are due to drivers who are speeding. Pursuant to New York Vehicle & Traffic Law § 1180, no person is allowed to operate a motor vehicle faster than what would be prudent or safe given the prevailing conditions of the roadway. If a bus driver fails to slow down in order to avoid a collision, this could form the basis of a negligence claim. Victims of school bus accidents tend to suffer very serious injuries.
The vast majority of school bus collisions are preventable. They tend to involve some amount of driver error. In many instances, more than one driver could be at fault.
