Property owners and construction companies can be held strictly liable for workplace accidents under New York Labor Law § 200. This law is a modification of an employer’s general responsibility to maintain their premises in a reasonably safe condition. According to the statute, “All places to which this chapter applies shall be so constructed, equipped, arranged, operated and conducted as to provide reasonable and adequate protection to the lives, health and safety of all persons employed therein or lawfully frequenting such places.” It is important that several actions are taken after any workplace accident in New York.
It can be difficult to know where to begin after any accidents at a construction site in New York. Victims are routinely left with catastrophic injuries that impair their ability to work or even perform daily activities. Unfortunately, employers and insurance providers are not likely to accept responsibility if someone is injured on their premises. It is important that victims understand they do have legal rights and are able to see some measure of accountability through a civil claim.
We at GLK Law extend our best wishes to the worker injured at Gloversville Middle School. It is our hope that he will be able to make a full recovery. Any person that may have more information about what happened should reach out to the police. There needs to be a thorough investigation into what went wrong for the sake of the victim’s family.
