His age and identity have not been released at this time.

Liability for Trenton Window Fall Accidents

Property owners in New Jersey have a legal obligation to maintain their premises in a safe condition. The state’s model jury charge for multi-family housing requires that landlords routinely inspect and maintain all of their properties. This is particularly important for windows, since they pose unique hazards for children. Window fall accidents are typically preventable when there are window guards. Other factors will be taken into consideration when evaluating liability.

  • Window Condition: The condition of the window should be taken into consideration. It matters whether there are rotted sills or missing screens.
  • Low Sills: Low sills on upper floor levels can also pose an unreasonable risk of injury.
  • Code Compliance: Another important consideration is whether the window was fully compliant with all building and housing codes.
  • Repair Requests: Any repair request involving the window should also be heavily scrutinized. A repair request can put the property owner on notice that there is an issue that needs to be addressed.

Falls from height remain one of the leading causes of preventable injury and death across New York City and the United States. According to the Centers for Disease Control and Prevention, falls were listed as the main cause of traumatic brain injuries from 2002 through 2006 and accounted for roughly 1.7 million TBIs each year. Any person injured in a fall accident may be able to pursue some measure of accountability through a civil action.
