Truck accidents remained one of the leading causes of preventable injury and death for pedestrians. According to National Public Radio, “Vehicles with higher front ends and blunt profiles are 45% more likely to cause fatalities in crashes with pedestrians than smaller cars and trucks, according to new research published Tuesday by the Insurance Institute for Highway Safety.” There are a number of steps that truck drivers should take in order to avoid collisions.
Truck drivers have a legal obligation to exercise a great deal of care in order to avoid collisions. They must be particularly cautious when a pedestrian is nearby. If a truck driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. It is important. That evidence is properly collected after any truck accident.
The vast majority of truck accidents are preventable. They tend to involve truck drivers who were traveling too fast for the prevailing conditions or committing other traffic infractions. In particular, many collisions are due to truck drivers that are making left turns. It is easy for a pedestrian or smaller vehicle to be obscured by the large blind spots of a commercial truck. The family of any person who died in a truck accident may have legal recourse through a wrongful death claim.
We at Gersowitz Libo & Korek, P.C. extend our deepest condolences to the family of the woman that died in this New Rochelle truck accident. Any person who may have more information about what happened should reach out to the police. This was a preventable tragedy that should have never taken place. It is our sincere hope that city officials will consider measures to help make this intersection safer for pedestrians.
