BROOKLYN, NEW YORK (September 4, 2024) – A 74-year-old woman has tragically died in an East Flatbush pedestrian accident by New York Avenue and Avenue D.
New York City officials are saying that the incident took place around 1:05 p.m. on Tuesday. The woman was crossing the intersection when she tripped and fell on a yellow rubber curb.
She was subsequently run over by a Honda Accord. Paramedics were called to the scene of the collision in order to help the victim.
The victim was taken to Kings County Hospital, where she was pronounced dead. A full investigation remains ongoing at this time.
Car accidents remain a leading cause of preventable injury and death across New York. According to the New York Department of Health, “Injuries to pedestrians are among the top 10 leading causes of injury-related hospital admissions and death for almost all age groups In New York State. Approximately 300 pedestrians are killed and 15,000 are injured by motor vehicles each year on the state’s roadways, and more than 3,000 pedestrians are admitted to the hospital annually.” Drivers should take several steps in order to avoid hitting pedestrians.
Drivers have a legal obligation to use caution in order to avoid causing accidents. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. It is important that certain steps are taken after any pedestrian accident.
Depending on the facts of any case, a municipal entity could face civil liability for a pedestrian accident. In general, a city could be liable for an accident caused by a dangerous condition on public property. This may include some defect with a crosswalk that causes pedestrians to trip. The family of any person that died in a pedestrian collision may have legal recourse through a civil claim.
