Liability for Corona Hit-And-Run Car Accidents

Every person operating a motor vehicle in New York owes a duty of care to the people with whom they share the road. Pursuant to Vehicle and Traffic Law § 1146, drivers must exercise due care to avoid colliding with any pedestrian they encounter. They must slow down as required and use their horn when necessary. If a driver is involved in any type of collision that results in injury, Vehicle and Traffic Law § 600 requires that they stop and report the incident. There are many different pieces of evidence that can help reveal how a collision took place.

  • Damage to the affected vehicle can be used to tie it to the crash. In particular, most vehicles involved in a hit-and-run will leave fragments of the same vehicle in the roadway.
  • Surveillance footage from nearby businesses or traffic cameras can also be used to trace the route of the fleeing vehicle.
  • Eyewitnesses also play an important role. They should be interviewed as early as possible, while their memories are still fresh.

If a driver fails to slow down to avoid colliding with any pedestrian in the roadway, they could be held legally responsible through a civil claim. Drivers accused of leaving the scene of an injury collision could also face criminal liability for their actions. Victims of an accident are protected by a number of laws. They’re able to seek a measure of accountability through a civil action. This right extends to surviving family members of any person who died in a car accident.
