Liability For Brooklyn Truck Accidents

Thousands of people are killed or seriously injured in truck accidents every year in the United States. According to the National Safety Council, “In 2022, 5,837 large trucks were involved in a fatal crash, an 1.8% increase from 2021 and a 49% increase in the last 10 years. The involvement rate per 100 million large-truck miles traveled is up 3% from 2021, and up 24% in the last 10 years.” There are a number of common causes of truck accidents.

  • Speeding
  • Distracted driving
  • Inclement weather
  • Poor road conditions

All truck drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a driver fails to slow down in order to avoid hitting a pedestrian, this could form the basis of a negligence claim. It is important that certain steps be taken after any truck accident.

  • Eyewitnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • A thorough investigation should be conducted.

Most pedestrian accidents are preventable and involve some amount of driver error. Drivers may be distracted or fail to notice their blind spots. It is important that accident victims understand that they do have rights. In particular, the family members of any person killed in a pedestrian collision may have legal recourse through a civil claim. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
