Jersey City police officials are saying that the incident took place late Tuesday. The woman fell through an elevator shaft that was open and missing an elevator.

This all happened as her granddaughter looked on in horror. Firefighters and paramedics were called to the scene in order to help the victim.

Liability For New Jersey Elevator Accidents

Elevators can be seriously dangerous when they are not properly maintained. According to the Centers for Disease Control, “Incidents involving elevators and escalators kill about 30 and seriously injure about 17,000 people each year in the United States, according to data provided by the U.S. Bureau of Labor Statistics and the Consumer Product Safety Commission.” There are a number of steps that construction companies can take to prevent people from being injured by falling elevators.

  • Elevators should be regularly inspected and properly maintained.
  • Elevators should be sectioned off with caution tape while they are being worked on.
  • Elevators should have safety devices such as door sensors and emergency brakes.

Building owners in New Jersey have a legal responsibility to maintain their properties in a reasonably safe condition. This must be done for the protection of everyone on a property whose presence is reasonably foreseeable. If a property is in a dangerous condition and the property owner fails to act, this could form the basis of a negligence claim. Victims of falls tend to suffer very serious injuries, including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

Many people don’t realize the full extent of their injuries for some time after an accident. People are filled with adrenaline when they are injured, and this can mask a person’s pain. Any person who is injured in an elevator accident may have legal recourse through a personal injury claim. A personal injury attorney can examine all of the unique facts of your case and let you know what your legal options are.
