Liability For Harlem Wrong Way Car Accidents

Wrong-way collisions are extremely dangerous. Many wrong-way collisions are due to driver intoxication. According to the NHTSA, “Every day, about 37 people in the United States die in drunk-driving crashes — that’s one person every 39 minutes. In 2022, 13,524 people died in alcohol-impaired driving traffic deaths.” There are many other contributing factors to wrong-way collisions.

  • Distracted driving
  • Inclement weather
  • Confusing freeway signs
  • Speeding

All drivers have a legal obligation to exercise due care in order to avoid collisions. There is a rebuttable presumption of negligence on the part of any driver who enters opposing lanes of traffic and causes a collision. It is important that evidence is properly preserved after any wrong-way collision. Evidence is what will ultimately be used to determine liability, regardless of what any person may claim.
