BROWNSVILLE, NEW YORK (September 1, 2023) – A man is in police custody after two pedestrians were struck by a van in Brownsville, Brooklyn.

New York City police officials are saying that the incident took place on Saturday afternoon. A Toyota Sienna was making a U-turn when it hit a 26-year-old woman and a 3-year-old.

Paramedics were called to the scene in order to help the victims. The two pedestrians were taken to the hospital with serious injuries.

Police have arrested a 61-year-old driver they believe was involved.

Liability For New York Pedestrian Accidents

Pedestrians are uniquely vulnerable to the hazards posed by motor vehicles. According to the New York State Department of Health, “Injuries to pedestrians are among the top 10 leading causes of injury-related hospital admissions and death for almost all age groups In New York State. Approximately 300 pedestrians are killed and 15,000 are injured by motor vehicles each year on the state’s roadways, and more than 3,000 pedestrians are admitted to the hospital annually.” Drivers should take a number of measures in order to avoid hitting pedestrians.

  • Drivers should slow down during periods of inclement weather.
  • Drivers should continuously scan the road ahead of them.
  • Drivers should abstain from alcohol and other intoxicating substances.

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians in the roadway. To that end, drivers must maintain a safe speed at all times. Depending on the prevailing conditions of the roadway, a driver may need to travel substantially below the speed limit. If a driver fails to slow down in order to avoid hitting a pedestrian, this could form the basis of a negligence claim. It is crucial that certain steps are taken after a car accident.

  • Victims should seek medical aid as early as possible.
  • Surveillance footage of the incident should be sought.
  • Eyewitnesses should be interviewed.
  • A personal injury attorney should be contacted.

It can be hard to know where to begin after a car accident. Victims may not realize the full extent of their injuries for several weeks or months. In many circumstances, accident victims may suffer long-term psychological trauma after their physical injuries have healed. Any person that is injured in a pedestrian accident may have legal recourse through a civil claim. A pedestrian accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
