HENRIETTA, NEW YORK (September 29, 2024) – A New York State Thruway worker has died and another was seriously injured in a Henrietta semi-truck accident on I-90.
Henrietta police officials are saying that the collision took place on Thursday afternoon. The construction workers were in a work zone when they were hit by a semi-truck.
Firefighters and paramedics were called to the scene in order to help the victims. One of the workers died due to their injuries.
The other worker was taken to Strong Memorial Hospital with critical injuries. A full investigation remains ongoing at this time.
Roadway construction zones remain very dangerous for workers. According to the National Safety Council, “In 2022, 891 people were killed and 37,701 people were injured in work zone crashes. Work zone crashes are defined as taking place within the boundaries of a work zone or on an approach to or exit from a work zone due to activities, behaviors, or controls related to traffic moving through the boundaries of a work zone.” There are a number of common causes of work zone accidents.
When a worker is killed or injured on the job, they or their family will typically have recourse through the worker’s compensation system. This system operates through a no-fault insurance scheme. The family of a deceased worker or injured worker may also have recourse through a third party liability claim. A third-party liability claim may be possible when an entity separate from a worker’s employer contributed to a collision. There could be numerous sources of third-party liability for any truck accident.
It can be hard to know where to begin after any truck accident. Many victims are left with life-altering injuries that impair their ability to return to work. When a worker is killed, their family may lose the income that they need to pay all of their bills. It is crucial that accident victims and their families understand that they do have rights in the event of a workplace fatality. The family of any worker who died in a work zone collision may be able to seek some measure of justice through a civil claim.
We at Gersowitz Libo & Korek, P.C. extend our deepest condolences to the family of the worker who died in this collision. It is our hope that the other worker will be able to make a full recovery. There needs to be a thorough investigation into what went wrong.
