Personal Injury Lawsuits Against DuPont for Diseases Linked to C8 Exposure

DuPont and C8 Exposure

For more than 60 years, DuPont has been using perfluorooctanoic acid (PFOA), also known as C8, to produce a variety of consumer products, such as Teflon, at their plant near the Ohio River Valley town of Parkersburg, West Virginia.

In 2002, C8 contamination was found in the water supply of several Ohio communities, including Belpre, Pomeroy, Tuppers Plains, and Little Hocking, and in Mason and Lubeck Counties in West Virginia. This contamination prompted the victims to file a class action lawsuit against DuPont. In 2005, the case was settled for $70 million. The plaintiffs chose to use the cash settlement to fund the C8 Health Project.

C8 Health Project

The C8 Health Project was formed to evaluate all of the available scientific data relating to C8 to determine whether it was more likely than not that the exposure was linked to serious human disease.

According to an article in The West Virginia Record, the C8 Science Panel concluded that a probable link exists between C8 exposure and the following illnesses:

  • Diagnosed high cholesterol
  • Kidney disease
  • Thyroid cancer
  • Testicular cancer
  • Ulcerative colitis
  • Pregnancy-induced hypertension (including preeclampsia)

According to the terms of the class-action settlement, DuPont is obligated to fund a $235 million medical monitoring program for any link found between C8 and any human disease. DuPont is additionally required to establish water treatment facilities for each of the communities whose water supply was affected by the exposure.

Filing Personal Injury Lawsuits

Affected class members are entitled to medical testing at DuPont’s expense and are permitted to move forward with personal injury or related wrongful death claims.

In addition, injured victims can also hire a personal injury attorney to represent them in an individual lawsuit against DuPont. These individual claims are separate from the class action lawsuits.
