BRONX, NEW YORK (November 26, 2024) – A person has tragically died in a Bronx MTA subway train accident near the 3rd Avenue-149th Street subway station.
New York City officials are saying the collision took place around 6:00 a.m. on Wednesday. A pedestrian was hit by a subway train for undetermined reasons.
Firefighters and paramedics were called to the scene in order to help the victim. They were treated at the scene.
But the pedestrian could not be saved and was later pronounced dead. A full investigation remains ongoing at this time.
Trains can be deceptively fast and dangerous. They are responsible for many serious injuries and deaths every year. According to the National Safety Council, “Railroad deaths totaled 995 in 2023, a 10% increase from the 2022 revised total of 908 and the highest since 2007. Nonfatal injuries totaled 6,705, a 3% increase from the 2022 revised total of 6,513. From 2022 to 2023, fatalities at highway-rail crossings decreased 9%, while fatalities involving other types of incidents increased 17%.” There are several factors that could contribute to an MTA accident.
Subway operators have a legal obligation to take reasonable steps in order to prevent collisions. This includes using their horns and slowing down to avoid hitting anyone on the tracks. If a subway operator fails to slow down to avoid a collision, this could form the basis of a negligence claim. It is crucial that subway accidents are properly investigated.
Subway accidents are largely preventable when all safety procedures are being followed. Sadly, though, subway train operators often don’t follow safety methods that are designed to keep people safe. In the event that they are involved in a fatal collision, they will do everything in their power to deny responsibility. This is why it is so important that accident victims understand that they do have rights. The family of any person who died in a train accident may have legal recourse through a civil claim.
We at Gersowitz Libo & Korek, P.C. extend our deepest condolences to the family of the pedestrian killed in this collision. Any person with more information should reach out to the NYPD. It is our sincere hope that measures are taken to prevent similar tragedies.
