Liability for Long Island Cement Truck Accidents

Cement trucks and dump trucks can be uniquely dangerous to pedestrians. According to the Engineering News-Record, “Dump truck accidents severe enough that the vehicle had to be towed away rose 9%, hitting 8,206 in 2016, the latest year statistics are available.” There are a number of factors that may contribute to pedestrian collisions.

  • Truck accidents are more likely when truck drivers are speeding.
  • Truck accidents are more likely at intersections, especially as drivers are making left turns.
  • Truck accidents are more likely during periods of reduced visibility or inclement weather.

Truck drivers have a legal obligation to take measures to avoid colliding with any pedestrian in the roadway. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. When drivers fail to avoid a pedestrian, they could be held at fault through a civil action. Several parties could be liable in a civil action.

  • The truck driver operating a vehicle.
  • The company that employed the truck driver.
  • The company that manufactured the truck involved in the crash.

It can be difficult to know what to do after any truck accident. Victims are often left with critical injuries and high medical bills. These injuries can impact their ability to be gainfully employed. It is important that victims understand that they do have legal rights. They are able to see some measure of accountability through a civil claim.
