Liability for Brooklyn Pedestrian Accidents

Many pedestrians are killed or seriously injured every year across New York City. According to Transportation Alternatives, “In the first nine months of 2024, 645 pedestrians were seriously injured in New York City. This is a 13% increase from the same period in 2023, and a significant increase in four of the five boroughs.” There are a number of common causes of pedestrian accidents.

  • Speed
  • Distracted driving
  • Inclement weather
  • Poor road conditions

Drivers have a legal obligation to exercise due care to avoid hitting pedestrians. They must be particularly cautious when making turns. Many pedestrian collisions take place as drivers make turns at intersections. If a driver fails to slow down to avoid hitting a pedestrian, this could be construed as negligence. It is important that certain measures are taken after any pedestrian accident.

  • The police should be called to the scene so that they can investigate.
  • Victims should seek a thorough medical evaluation.
  • The contact information of eyewitnesses should be sought.
  • Any person injured should seek the guidance of an experienced pedestrian accident attorney.

It can be difficult to know where to begin after any pedestrian accident. Victims often sustained life-changing injuries that impaired their ability to work or to simply live normally. Any person injured in a pedestrian accident may be able to seek some measure of accountability through a personal injury claim. Family members of any person killed in a pedestrian accident may be able to pursue damages through the wrongful death claim.
