Many accidents involving drivers who were pinned by their own vehicles involve instances where those vehicles inadvertently rolled. According to Safety Research Strategies, “an estimated 12,247 people were killed in non-traffic crashes, averaging 2,449 people each year. Rollaways accounted for 17 percent of the total, with an average of 144 deaths per year. On average, rollaway vehicles injured about 1,886 nonoccupants each year, about 7 percent of that total.” There are several common causes of rollaway accidents.
Depending on the facts of any case, there could be numerous sources of liability for any instance where a worker is injured by a rollaway vehicle. For example, the company that manufactured the vehicle involved in the accident could be held at fault. Car companies have a legal obligation to create vehicles that are reasonably safe. Jeep and Fiat Chrysler have faced lawsuits for rollaway accidents caused by faulty gear shifter mechanisms. It is important that certain steps are taken after any rollaway accident.
It can be hard to know where to begin after any serious accident. Victims may need to take extensive periods of time away from work. They could also be left with high medical bills. Accordingly, an accident might affect both an individual and their entire family. It is important that victims understand that they do have rights. They are able to seek compensation through a civil claim. A personal injury attorney can examine all of the unique facts of your case and let you know what your legal options are.
We at Gersowitz Libo & Korek, P.C. extend our best wishes to the man injured in this Pomona oil delivery truck accident. It is our sincere hope that he is able to make a full recovery.
