Liability For Manhattan Garbage Truck Accidents

According to one report from the Federal Motor Carrier Safety Administration (FMCSA), there are around 2,500 garbage truck fatalities every year. Garbage trucks have large blind spots that can obscure the presence of pedestrians. There are a number of measures that garbage truck drivers should take in order to avoid hitting pedestrians.

  • Garbage truck drivers should check their blind spots before making turns.
  • Garbage truck drivers should avoid left turns as much as possible.
  • Garbage truck drivers should abstain from alcohol and other intoxicants.

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. When a driver intends to back up, they have to make sure that there are no pedestrians behind them. There is simply no excuse for a truck driver backing over a pedestrian. Several different factors could contribute to any pedestrian accident involving a garbage truck.

  • A garbage truck driver may have been distracted.
  • A garbage truck driver may have been fatigued.
  • A garbage truck driver may have been speeding.

Depending on the facts of any case, liability for a garbage truck accident could extend beyond any driver. For example, a garbage truck company could be liable for the wrongful actions of their drivers. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties.
