Liability for New York Electrocution Accidents

Electrocutions remain one of the most common causes of preventable injury and death. Many of these injuries involve workers. According to OSHA, “Nationally, the Bureau of Labor Statistics reports a 3.75 percent increase – 166 workplace deaths related to electrocution – in 2019 over the previous year. From Nov. 6, 2018, through Oct. 3, 2021, OSHA investigated 12 electrical-related deaths in Missouri and Kansas.” There are a number of sources of electrocution in the workplace.

  • Workers could potentially be electrocuted due to exposed wiring.
  • Workers could be electrocuted due to damaged or ungrounded electrical equipment.
  • Workers could be electrocuted due to overloaded circuits.

Depending on the facts of any case, a property owner could face liability if a person is injured on their property in New York. All property owners have a legal obligation to maintain their premises in a reasonably safe condition for all people whose presence on a property is reasonably foreseeable. If a property owner has actual or constructive notice that their property is in a dangerous condition, they must take action. There are a number of ways that property owners could help prevent electrocutions.

  • Property owners should conduct regular electrical inspections.
  • Property owners should install ground fault circuit interrupters.
  • Property owners should cover exposed wires and electrical outlets.

Electrocutions can leave victims with horrific injuries. The accidents can affect a person’s central nervous system, brain, and organs. Many victims are never able to fully recover. It is important for victims of electrocution accidents to understand that they do have rights. Any person injured in such an accident may be able to seek some measure of justice through a personal injury claim.
