Bus companies are considered common carriers. Their drivers must operate with an abundance of caution to avoid causing accidents. Many bus accidents are due to bus drivers that make dangerous lane changes. Pursuant to NY Veh & Traf L § 1128, “A vehicle shall be driven as nearly as practicable entirely within a single lane and shall not be moved from such lane until the driver has first ascertained that such movement can be made with safety.” There are numerous sources of negligence that may have contributed to a bus accident.
If a bus driver’s negligence contributed to a bus accident in some way, their employer could be held at fault for the crash. Generally speaking, companies are liable for the wrongful actions of their employees–insofar as those employees were working within the course and scope of their job duties. This will include instances where a bus is being used to transport paying customers.
Bus accidents are quite common and leave victims with serious injuries. According to The Journalist’s Resource, “on average, about 63,000 buses [of all kinds] are involved in an accident each year; about 14,000 result in an injured person, and 325 result in a fatal injury.” Victims of bus accidents should take a number of steps to preserve their legal rights, health, and financial well-being.
There are a number of laws designed to help victims of bus accidents. They are able to seek some measure of accountability through a personal injury claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering. The FMCSA requires buses that can carry 16 or more people to have at least $5 million in liability coverage. If you’ve been injured in a tour bus accident, the best thing that you can do is reach out to a lawyer as soon as possible.
We at GLK Law extend our deepest condolences to all of the families who lost loved ones in this Pembroke tour bus crash. Any person that may have more information about what happened should reach out to investigators. This was a preventable tragedy that should have never taken place. Many questions remain unanswered. When was the last time this bus was inspected or maintained? What was the speed of the tour bus prior to the collision?
