Five Injured in Amtrak Train Fire at New York’s Penn Station

Investigation Underway After Amtrak Maintenance Vehicle Caught Fire in a Hudson River Tunnel, Which Suspended Penn Station Service

MANHATTAN, NEW YORK (May 29, 2026) – At least five people were injured at New York’s Penn Station after an Amtrak service train caught fire.

New York City officials are saying that the accident took place around 6 AM on Friday. For undetermined reasons, the train caught fire and filled the passenger cars with smoke.

Five people were injured in the fire and transported to local area hospitals. Two people reportedly sustained serious injuries.

It remains unclear what may have caused the Amtrak train to catch fire. Several tracks were affected due to the extensive damage caused by the fire.

Liability for Manhattan Train Fires

Property owners in New York have a legal obligation to maintain their premises in a reasonably safe condition. Moreover, property owners must warn of dangerous defects on a property that the defendant “should know or suspect that the licensee will not discover himself after a reasonable inspection of the premises” (Velez v City of New York, 45 AD2d 887). This requires that train stations abide by all fire and safety codes. There are many ways that a train station may have acted negligently and thus contributed to a fire.

  • A station may have been negligent if they allowed old wiring or damaged circuits to not be repaired.
  • A station may have failed to install or maintain adequate fire suppression systems.
  • A station may not have had sufficient smoke detectors or alarms.
  • A station may have stored combustible materials like gasoline improperly.

If a train station or other property in New York has actual or constructive notice of a dangerous condition on their premises, they must take action. Failing to take action to correct a dangerous condition could form the basis of a negligence claim. Depending on the specific facts of any case, there could be multiple sources of liability for any fire at a train station. For example, a contractor could face liability if they started a fire accidentally. The specific details really matter when assessing who could legally be at fault.

Steps to Take After New York City Train Fires

Preventable fires remained a leading cause of serious injury and death across New York City in the United States. According to one study in Science Direct, “Structural fires, defined as incidents occurring in or on structures, remain a critical challenge in modern cities. In 2023, the United States (US) alone recorded 470,000 structural fire incidents.” Certain action should be taken after any person is injured in an Amtrak fire.

  • Victims should seek a thorough medical evaluation. Even seemingly minor injuries for smoke inhalation can turn out to be far more serious.
  • The source of the fire should be determined. This can help reveal what parties could be legally responsible.
  • Maintenance records for the train that caught fire should be carefully reviewed. These records can help reveal major safety lapses.
  • Any person injured in an Amtrak train fire should seek an independent investigation by a team experienced in premises liability claims.

It can be difficult to know where to begin after being injured in a train fire. Many victims are left with high medical bills and may need to take extensive periods of time away from work. Burn injuries are among the most difficult to treat. They often require extensive skin grafts. Any person injured in a New York City train station fire may be able to pursue some measure of accountability through a civil claim. A personal injury attorney can examine the unique facts of your case and let you know what your legal options are.
