He was airlifted to Erie County Medical Center in critical condition. Unfortunately, he was pronounced deceased at the hospital.

Liability for New York Accidents Involving Road Debris

New York law requires vehicle owners and operators to use reasonable care to prevent accidents. This necessitates that they properly secure all items on or attached to their vehicle that could potentially cause harm. New York Vehicle and Traffic Law § 377 requires drivers to properly secure all of their cargo with any necessary chains or cables to prevent materials from leaving their vehicle and becoming hazards. It is important that several steps are taken after any accident involving debris that came off of a vehicle.

  • The police should be called to the scene as early as possible so that they can begin investigating.
  • All medical records related to the incident should be preserved.
  • Photos that document the debris involved and the condition of the other vehicle should be taken.
  • The family of any person who died in a collision involving road debris should consider their legal options and consult a team experienced in accident claims.

When a driver fails to secure road debris that leads to a collision where someone is injured, this could be used to demonstrate negligence. Depending on the specific facts of any case, there could be numerous sources of liability for any collision involving road debris. This includes any company responsible for securing cargo that came loose. For example, employees of a furniture store may have failed to secure some piece of furniture that tumbled into the roadway and injured another driver. The family of any person who died in an accident involving road debris may be able to seek some measure of accountability for a wrongful death claim.
