The driver that hit him has since been charged with negligent homicide and reckless endangerment. A full investigation remains ongoing at this time.
Car accidents are a leading cause of serious injury and death for workers. According to the Bureau of Justice Statistics, “There were 54,750 nonfatal work-related transportation incidents involving one or more days away from work in 2020, down from 64,210 in 2019. […] There were 7,520 pedestrian vehicle incidents in 2020, which accounted for 13.7 percent of all work-related transportation incidents involving days away from work.” There are a number of factors that may contribute to construction zone accidents.
Construction companies have a legal obligation to protect their workers from reasonably foreseeable sources of harm. They must maintain construction sites in a reasonably safe condition. If a construction company fails to take reasonable measures to protect workers from car accidents, they could be held at fault. There are several measures that can be taken to protect construction zones.
Car accidents in construction zones are often highly preventable. They tend to involve at least some amount of negligence on the part of drivers. Any person that is injured in a construction zone accident may be able to seek some measure of justice through a civil claim. The family of any person who died in a collision may be able to seek accountability through a wrongful death claim.
We at Gersowitz Libo & Korek, P.C. extend our deepest condolences to the family of the worker who died in this crash. Any person who may have more information about what happened should reach out to the NYPD. This was a preventable tragedy that should have never taken place.
