QUEENS, NEW YORK (October 19, 2024) – A bicyclist has tragically died in a Queens car accident near the intersection of 4th Avenue and 34th Street.
New York City officials are saying that the collision took place around 7:35 a.m. on Monday. A truck driver was making a right turn when they collided with a bicyclist.
Firefighters and paramedics were called to the scene in order to help the victim. Despite life-saving measures, the victim was later pronounced dead.
A full investigation remains ongoing at this time.
Trucks make up a relatively small number of the total vehicles on the road. But they are involved in a disproportionate number of fatal collisions. According to the FMCSA, “Elements that influence the occurrence of a crash may take place hours, days, or months before the crash. They include driver training and experience, vehicle design and manufacture, highway condition and traffic signaling, and weather conditions.” Truck drivers should take a number of measures in order to avoid collisions.
All drivers must take reasonable measures in order to avoid collisions. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a truck driver fails to slow their vehicle in order to avoid a cyclist, this could form the basis of a negligence claim. Victims of bicycle accidents often suffer very serious injuries.
Bicycle accidents are often preventable. This is particularly true when they involve drivers making turns. In far too many situations, drivers initiate turns without checking their blind spots. It is critical that accident victims understand that they do have rights. The family of any person who died in a truck accident may be able to seek some measure of justice through a wrongful death claim.
