MIDTOWN, NEW YORK (March 8, 2025) – A construction worker has tragically died in Midtown Manhattan after falling from an elevated position along East 49th Street.
New York City officials are saying that the accident took place around 9:40 AM on Thursday. A construction worker was helping an electrician when he fell multiple stories.
Paramedics were called to the scene in order to help the victim. Despite life-saving measures, the construction worker was pronounced dead at the scene.
The Department of Buildings has issued a stop work order as they continue to investigate.
Falls remain one of the leading causes of construction accidents in New York City. According to the Centers for Disease Control, “In 2022 falls from elevation represented approximately 81% of all fatal and 20% of all nonfatal slips, trips, and falls for all industry workers (BLS 2023a, BLS 2023b). Many of these falls occurred in the construction industry, and significantly impact construction employers, workers, and their families.” Construction companies should take a number of measures in order to prevent falls.
Building owners and general contractors are strictly liable for gravity-related accidents under New York Labor Law 240. This includes instances when a worker falls or is struck by a falling object. Construction owners and contractors must provide scaffolds and other safety measures to protect workers from falls. It is important that certain steps are taken after any workplace falls.
Falls are often highly preventable at construction sites. They tend to happen when safety regulations are not being followed. This might include situations where construction workers are not being provided adequate safety equipment. Construction workers and their families are protected by a number of laws. The family of any construction worker killed in an accident may be able to seek some measure of accountability through a civil claim.
We at Gersowitz Libo & Korek, P.C. extend our best wishes to the family of the worker that died in this midtown Manhattan construction accident. Any person who may have more information should reach out to OSHA. There needs to be a thorough investigation into what went wrong so that similar tragedies can be prevented.
