FAIRPORT, NEW YORK (March 24, 2024) – A construction worker was injured in Fairport when the floor beneath him collapsed at a business on North Main Street.
Fairport police officials are saying that the incident took place on Tuesday afternoon. A construction worker was working at a business on some type of renovation project.
The worker and a forklift went through the floor. Firefighters and paramedics were called to the scene in order to help the worker.
He was eventually extricated before being given medical treatment. A full investigation remains ongoing at this time.
Despite many improvements in workplace safety standards, the construction industry is still plagued by a high number of injuries and fatalities. Accidents that involve being struck by objects are one of the categories of accidents dubbed the “fatal four” by OSHA. The vast majority of floor collapses are totally preventable and due to lax safety protocols. There are a number of signs that a roof or building may be at risk of structural collapse.
Depending on the facts of any case, a construction company could be liable for a construction accident under New York Labor Law § 200. This statute codifies an employer’s general duty to maintain job sites in a safe condition. According to the statute, “All machinery, equipment, and devices in such places shall be so placed, operated, guarded, and lighted as to provide reasonable and adequate protection to all such persons.” It is important that certain steps be taken after any construction accident.
It can be hard to know what to do after any construction accident. Many victims are so seriously injured that they may need to take extensive time off of work. It is important that victims of construction accidents understand that they do have rights. Any person who is injured in a construction accident may be able to seek some measure of justice through a civil claim. A construction accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
We at Gersowitz Libo & Korek, P.C. extend our best wishes to the worker injured in this Fairport construction accident. Any person who may have more information about what happened should reach out to OSHA. It is our sincere hope that steps are taken to prevent other accidents like this.
