Bicyclist Killed in Queens Car Accident on 108th Street

BMW Driver Opened Door of Vehicle Leading to Fatal Collision in Queens

QUEENS, NEW YORK (March 17, 2026) – A pedestrian has tragically died in a Queens car accident near the intersection of 108th Street and 38th Street.

New York City officials are saying that the collision took place around 6:30 PM on Monday. A cyclist was heading down the roadway when a BMW driver suddenly opened the door to their vehicle.

The cyclist hit that vehicle, causing them to sustain serious injuries. Paramedics were dispatched to the scene of the crash to help the victim.

The bicycle rider was transported to a nearby hospital with major head injuries. Sadly, they were later pronounced dead at the hospital.

Liability for Queens Bicycle Accidents

Drivers must use caution to avoid colliding with any pedestrian or cyclist in the roadway. According to New York Vehicle Code 1146, “Notwithstanding the provisions of any other law to the contrary, every driver of a vehicle shall exercise due care to avoid colliding with any bicyclist, pedestrian, or domestic animal upon any roadway and shall give warning by sounding the horn when necessary.” Victims of pedestrian accidents tend to suffer very serious injuries.

If a driver fails to slow down to avoid colliding with another vehicle, this could form the basis of a negligence claim. A driver could also be liable for suddenly opening their door into the path of a cyclist. Drivers must be aware of their environment and only open their doors when it is safe to do so.
