BRONX, NEW YORK (July 29, 2024) – One construction worker has died in a Mott Haven, Bronx elevator collapse accident at a building on Bruckner Boulevard.
New York City Police are saying that the accident took place around 8:17 a.m. on Wednesday. A construction worker was working with some type of equipment in an elevator.
At some point, the elevator fell from the fourth floor to ground level. Firefighters and paramedics were called to the scene of the accident in order to help the victims.
A supervisor at the scene died due to their injuries, and another worker was critically injured.
Elevator falls remain a major cause of serious injury and death in the United States. According to the Centers for Disease Control, “Incidents involving elevators and escalators kill about 30 and seriously injure about 17,000 people each year in the United States, according to data provided by the U.S. Bureau of Labor Statistics and the Consumer Product Safety Commission.” Construction companies should take a number of measures in order to protect workers from elevator falls.
Building owners and general contractors in New York could be strictly liable for an elevator fall under New York Labor Law § 240. The statute covers all gravity related accidents, including incidents where workers fall or are struck by falling objects. The statute will apply when a worker is engaged in “the erection, demolition, repairing, altering, painting, cleaning or pointing of a building or structure.” It is important that certain steps are taken after any elevator accident.
