Liability for Jersey City Truck Accidents

Bicyclists are uniquely vulnerable to the hazards posed by motor vehicles and continue to be overrepresented in fatal collisions. According to the National Safety Council, “Of the 1,377 bicyclist deaths in 2023, 937 died in motor-vehicle crashes and 440 in other incidents, according to National Center for Health Statistics mortality data. Males accounted for 89% of all bicycle deaths, over eight times the fatalities for females.” Commercial trucks can be particularly hazardous to bicyclists.

  • Trucks have large blind spots that can obscure the presence of bicyclists.
  • Trucks take substantially longer to bring to a safe stop.
  • Trucks are much more difficult to maneuver safely than smaller vehicles.

Truck drivers must operate with an abundance of caution to avoid colliding with any pedestrian in the roadway. They must slow down when necessary and use their horn to alert others of their presence. When a truck driver fails to slow down to avoid colliding with any pedestrian in the roadway, they could potentially be held at fault through a civil claim. It is essential that evidence be properly preserved after any truck accident.

  • Photos of the accident site should be taken.
  • Medical records related to the accident should be preserved.
  • Eyewitnesses should be interviewed.
  • The safety record of the truck driver involved should be investigated.

The majority of truck accidents are preventable. In fact, 93% of all fatal collisions involve some amount of human error. Part of the problem is that many truck drivers are pushed to complete their delivery routes on unrealistic time schedules. Drivers are much more likely to make serious mistakes when they are fatigued.
