Investigation Underway After Pedestrian Killed In Collision With MTA-Operated Bus In Kips Bay by 28th Street and Third Avenue
KIPS BAY, NEW YORK (June 19, 2025) – A pedestrian has tragically died in a Kips Bay MTA bus accident near the intersection of 28th St. and Third Avenue.
New York City police are saying that the accident took place around 5:33 AM on Monday. A pedestrian was trying to cross the road when they were struck by the bus.
Paramedics were called to the scene of the collision to help the victim. He was transported to the hospital with critical injuries.
Sadly, he was beyond medical aid and pronounced dead at the hospital.
Bus accidents similar to the one in Kips Bay have become increasingly more common. According to The Journalist’s Resource, “on average, about 63,000 buses [of all kinds] are involved in an accident each year; about 14,000 result in an injured person, and 325 result in a fatal injury. About 50 passengers (including the driver) are killed, on average, in a given year.” Several factors make bus accidents more likely.
Bus drivers are considered common carriers and must operate with an abundance of caution to avoid causing harm to their passengers or pedestrians. To that end, they must check their blind spots before making turns and continuously scan the road ahead of them for hazards. If a bus driver fails to slow down to avoid colliding with any pedestrian in the roadway, they could be held at fault through a civil claim. Several actions should be taken following any bus accident.
New York City remains one of the busiest locations for pedestrians. The vast majority of accidents involving pedestrians are completely preventable. They tend to involve drivers that are committing traffic infractions. Sadly, bus companies will do everything in their power to avoid responsibility for any collision. The family of any person who died in a bus accident may be able to seek some measure of justice through a civil claim.
We at GLK Law extend our deepest condolences to the family of the man killed in this Kips Bay bus accident. Any person who may have more information about what happened should reach out to the police. There needs to be a thorough investigation into what happened.
