Liability for Long Island Construction Accidents

Far too many people are killed or seriously injured in accidents involving forklifts each year. According to the National Safety Council, “Forklift-related injuries are also cross-categorized by event type, most often as either a transportation incident or contact with object or equipment incident. Forklifts were the source of 67 work-related deaths in 2023 and 24,960 DART cases that include 15,480 DAFW cases in 2021-2022.” It is important that certain action be taken to prevent forklift accidents.

  • Forklift operators should receive ample training.
  • Workers should communicate with each other, especially when they are using heavy equipment.
  • Worksites should be well illuminated.

Businesses in New York must maintain job sites in a safe condition. They must follow all regulations and mitigate hazards. According to New York Labor § 200, “All places to which this chapter applies shall be so constructed, equipped, arranged, operated and conducted as to provide reasonable and adequate protection to the lives, health and safety of all persons employed therein or lawfully frequenting such places.” Heavy machinery can cause serious injuries.

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord trauma

Construction accidents are often preventable. They can easily be prevented when safety regulations are strictly being followed. It is important for victims to understand that they have legal options. This applies to the surviving member of any person killed in a workplace accident. They are able to receive some measure of accountability through a civil action.
