Subway Worker Seriously Injured In Brooklyn Train Accident

Subway Worker Recovering In ICU After Brooklyn Train Accident

BROOKLYN, NEW YORK (July 27, 2024) – A subway worker was seriously injured in a Brooklyn train accident near the Hoyt-Schermerhorn Streets station.

New York City officials are saying that the incident took place early Thursday. A 64-year-old worker was hit by an out-of-service F train and sustained a major head injury.

Firefighters and paramedics were called to the scene in order to help the worker. He was taken to Bellevue Hospital and listed in critical condition.

A full investigation remains ongoing at this time.

Liability For Brooklyn Subway Train Accidents

Despite many improvements to workplace safety standards every year, far too many people are seriously injured or killed during their course of employment. According to the National Safety Council, “The number of preventable work deaths increased 5% in 2022, totaling 4,695. In addition to preventable fatal work injuries, 791 homicides and suicides occurred in the workplace in 2022. These intentional injuries are not included in the preventable-injury estimates.” Agencies that manage subways should take a number of measures in order to keep workers safe.

  • Agencies should conduct regular risk assessments to identify potential hazards.
  • Agencies should maintain clear lines of communication between all workers and train operators during work projects.
  • Agencies should provide comprehensive training to workers on safety protocols.

Depending on the facts of any case, there could be numerous sources of liability for any subway accident. A general contractor could be liable under New York Labor Law 200. General contractors have a legal obligation to maintain worksites in a reasonably safe condition. When a general contractor has actual or constructive notice of a dangerous condition and fails to take action, this could form the basis of a negligence claim. It is important that certain steps are taken after a subway accident.

  • Eyewitnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • A thorough investigation should be conducted.

Many workplace accidents are preventable. They are much more likely to take place at job sites that do not foster a culture of safety and protection for workers. In particular, a number of companies and agencies have engaged in cost cutting techniques that make workplace accidents more likely. Any person who is injured in a subway accident may have legal recourse through a civil claim. A personal injury attorney can examine all of the unique facts of your case and let you know what your legal options are.
