Far too many pedestrians are killed or seriously injured every year in collisions with subways and trains. According to the National Safety Council, “Railroad deaths totaled 954 in 2024, a 1% decrease from the 2023 revised total of 967. Nonfatal injuries totaled 6,542, a 3% decrease from the 2023 revised total of 6,768. From 2023 to 2024, fatalities at highway-rail crossings increased 7%, while fatalities involving other types of incidents decreased 4%.” Subway operators should take many steps to avoid pedestrian accidents.
Subway operators have a legal obligation to exercise due care to avoid collisions. They must stop to avoid colliding with any pedestrian, even when that pedestrian may be stationary on a set of train tracks. If a subway operator fails to slow down to avoid hitting a pedestrian on a set of tracks, the city or company that they work for could potentially be held liable. It is important that certain steps are taken after any subway accident.
New York City’s subway system has one of the highest instances of passengers and pedestrians being injured. Many of these incidents involve people being assaulted. A number of victims are hit by subway trains. It is important for accident victims to understand that they do have legal rights. The family of any person killed in a subway train accident may have legal recourse through a wrongful death claim.
