One Person Killed In East Farmingdale Tow Truck Accident

New York State Police Investigating Tow Truck Accident on Route 109 In East Farmingdale

EAST FARMINGDALE, NEW YORK (February 18, 2024) – A pedestrian has tragically died in an East Farmingdale tow truck accident on Route 109 by Route 110.

Suffolk County officials are saying that the collision took place around 2:30 a.m. on Tuesday. A pedestrian was crossing the roadway when they were hit by a tow truck.

The force of the impact knocked the victim to the ground with critical injuries. Paramedics were called to the scene in order to help the victim.

Sadly, they were pronounced dead at the scene. The driver of the tow truck remained at the scene and cooperated with police.

Liability For Suffolk County Tow Truck Accidents

Pedestrians are uniquely vulnerable in car accidents. They lack the protection of enclosed vehicles and are more likely to be overlooked. According to the IIHS, “A total of 7,388 pedestrian deaths occurred in 2021. Pedestrian fatalities increased 13% from 2020, and account for 17% of all crash fatalities. Although pedestrian deaths were 2% lower in 2021 than in 1975, they have increased 80% since reaching their lowest point in 2009.” There are a number of common causes of car accidents.

  • Speeding
  • Distracted driving

  • Dangerous left turns
  • Driver intoxication

Many pedestrian accidents are preventable and involve drivers that commit traffic infractions. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists and domestic animals in the roadway. If a driver fails to reduce their speed in order to avoid a collision, this could form the basis of a negligence claim. It is important that evidence is properly preserved after any collision.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • Photos of the accident site should be taken.

If a tow truck driver was working at the time of a collision, their employer could be held at fault. In general, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course of their job duties. The family of any person that died in a pedestrian accident may hav legal recourse through a civil claim.
