Liability for New York Car Accidents

Speeding remains one of the most common factors for car accidents. According to the National Safety Council, “Speeding was a factor in 29% of all traffic fatalities in 2023, killing 11,775, or an average of over 32 people on a typical day. The total number of fatal motor-vehicle crashes attributable to speeding was 10,541.” Speeding increases the odds of a collision in several ways.

  • Drivers are more likely to lose control of their vehicles at higher speeds.
  • Drivers are more likely to roll over at higher speeds.
  • Drivers are more likely to rear-end the vehicles ahead of them at higher speeds.

Every driver in New York must operate with the care necessary to prevent accidents. To that end, they must continuously scan the road ahead of them and slow down to avoid hitting other vehicles. Many collisions involved drivers that make dangerous left turns. If a driver turns left into the path of an oncoming vehicle, this could form the basis of a negligence claim. Victims of car accidents tend to suffer serious injuries.

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord trauma

Car accidents are often highly preventable. They tend to be the result of drivers speeding or committing other traffic infractions. Any person that is injured in a car accident may be able to seek some measure of accountability through a civil action. An attorney can examine the unique facts of your case free of cost and let you know what your legal options are.
