MANHATTAN, NEW YORK (July 26, 2024) – A man has tragically died in a Union Square subway train accident involving a Q line train.
New York City officials are saying that the accident took place during rush hour on Monday. A Q line train was headed south about 8:30 a.m. when it hit a pedestrian.
Firefighters and paramedics were called to the scene of the collision in order to help the victim. Despite life-saving measures, the pedestrian later died due to their injuries.
A full investigation into the Union Square accident remains ongoing at this time.
Train accidents remain far too common in the United States. According to Statista, “In 2023, the United States registered 995 rail fatalities and around 6,700 non-fatal injuries on the railroads. Injury and fatality numbers had fallen during the COVID-19 pandemic in 2020 and 2021, but 2022 saw a resurgence of accidents above pre-pandemic levels.” Subway train operators should take a number of measures in order to avoid collisions.
Private companies and municipal entities that operate trains have a legal obligation to exercise due care in order to avoid hitting pedestrians. This is true even if a pedestrian is standing still on a set of tracks. Train operators must use their brakes and take action in order to avoid collisions. If a train operator fails to slow down in order to avoid a collision, this could form the basis of a negligence claim. It is important that certain steps are taken after any train accident.
People are often quick to blame pedestrians in the event of a train accident. But the fact of the matter is that many train accidents involving pedestrians involve some amount of train operator negligence. This could include instances where drivers fail to use their horn or slow down. The family of any person who died in a train accident may be able to seek some measure of justice through a civil claim.
We at Gersowitz Libo & Korek, P.C. extend our deepest condolences to the family of the man who died in this Union Square train accident. Any person who may have more information about what took place should reach out to investigators. There needs to be a thorough investigation into what went wrong.
