New York City officials are saying that the accident took place around 5:46 PM on Tuesday. A pedestrian was hit by a white sedan.

The driver of the sedan fled the scene and is currently being sought by police. Paramedics were called in order to help the man. Sadly, he was pronounced dead at the scene.

A full investigation remains ongoing at this time.

Liability for New York City Hit-and-Run Collisions

Thousands of people are harmed in hit-and-run collisions every year. According to the AAA Foundation for Traffic Safety, β€œIn 2016, there were 1,980 fatal hit-and-run crashes resulting in 2,049 fatalities. This is the highest annual number of hit- and-run fatalities or crashes recorded since NHTSA began compiling statistics on fatal motor vehicle crashes in 1975.” There are a number of factors that could contribute to a hit-and-run collision.

  • Distracted driving
  • Speeding
  • Driver intoxication
  • Poor road conditions

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. They must reduce their speed and use their horn to alert pedestrians of their presence when necessary. If a driver fails to slow down in order to avoid hitting a pedestrian, this could form the basis of a negligence claim. It is important that certain steps are taken after any pedestrian accident.

  • Fragments of the fleeing vehicle should be sought.
  • Medical records related to the incident should be preserved.
  • Eyewitnesses should be interviewed.
  • A thorough investigation should be conducted.

Hit-and-run collisions are nearly always preventable. They tend to involve drivers who are not scanning the road ahead of them. In many cases, these drivers may be intoxicated and afraid of being taken to jail if they remain at the scene. It is important for victims in their families to understand that they do have rights. In particular, the family of any person who died in a hit-and-run collision may be able to seek some measure of accountability through a wrongful death claim.
