Liability for Sommerset County Car Accidents

Every driver in New Jersey must operate with the care necessary to avoid colliding with any pedestrian in the roadway. Pursuant to New York Vehicle Code 1146, “Notwithstanding the provisions of any other law to the contrary, every driver of a vehicle shall exercise due care to avoid colliding with any bicyclist, pedestrian, or domestic animal upon any roadway and shall give warning by sounding the horn when necessary.” Drivers may act negligent prior to hitting a pedestrian in a number of different ways.

  • A driver may be traveling at a speed that is unsafe given the prevailing road conditions.
  • A driver may be distracted by looking at their phone or other objects.
  • A driver may be intoxicated by alcohol or other substances.

The vast majority of pedestrian accidents are preventable. They often involve situations where drivers are traveling at an unsafe speed given the prevailing traffic conditions. During periods of inclement weather, drivers may need to travel well below the stated speed limit to remain safe. Any person injured due to the negligent actions of a driver may be able to pursue some measure of justice through a personal injury claim.
