Joint-Replacement Maker Exactech Inc. Will Face Combined Proceeding In New York Court By Patients Alleging They Were Harmed By Recalled Hip and Knee Implants
NEW YORK, NEW YORK (October 27, 2022) – Numerous lawsuits brought against Exactech Inc. have been consolidated to a combined proceeding before one court in New York.
Plaintiffs have alleged that they have been harmed by flawed components that were in the hip, knee, and ankle prostheses sold by the company. In general, these devices prematurely failed which required their recipients to need surgery.
According to the company’s Urgent Medical Device Correction letter, the packaging for the inserts did not protect them from oxygen exposure. Exposure to oxygen can degrade the inserts and lead to device failure.
Some people have reported experiencing bone loss. Others were injured by component cracking. It is common for people with defective implants to have symptoms that include lysis, swelling, difficulty walking and pain at the implant site.
Lawyers for the plaintiffs injured by Exactech implants have argued that the company was negligent in numerous ways.
U.S. District Judge Nicholas Garaufis of the Brooklyn-based Eastern District of New York is set to overhear the cases. One-third of the cases were already filed in the Eastern District of New York prior to the consolidation.
